Section 34 is the part of the Environmental Protection Act 1990 that creates the waste duty of care. It requires anyone who produces, keeps, carries or disposes of controlled waste to prevent its escape, transfer it only to an authorised person, and describe it in writing. Breaching it is a criminal offence.
